If someone else is at-fault, start with their insurance.
why pay for something when you are not at fault?

A client recently came into my office with a police report stating she had just been in an accident. The police officer told her to bring the accident report to her insurance agent to file a claim.
Of course, I first asked if she was ok, which thankfully she was.
I then asked what happened. She began to tell me the details of the incident. To sum it up, the other vehicle was at fault. I advised her she needs to call the other person’s carrier to see if a claim had been filed. If not, go ahead and report it to that carrier.
She looked confused and said” I thought I had to report it under my coverage.” I advised her if you are not at fault, you report it to the carrier of the insured that is at fault. If she were to report it under her policy, she may be subject to a deductible that will need to subrogate against. This could take a while to get back. So why pay for something when you are not at fault?
Now there are circumstances as to why you may need to report it to your carrier. Talk to your agent before deciding what to do.
